Modern theorists often use Immanuel Kant's work to defend the normative primacy of human rights and the necessity of institutionally autonomous forms of global governance. However, properly understood, his law of nations describes a loose and noncoercive confederation of republican states. In this way, Kant steers a course between earlier natural lawyers such as Grotius, who defended just-war theory, and visions of a global unitary or federal state. This substantively mundane claim should not obscure a more profound contribution to the (...) science of international law. Kant demonstrates that his concept of law forms part of a logical framework by which to ascertain the necessary institutional characteristics of the international legal order. Specifically, his view is that the international legal order can only take a noncoercive confederated form as its subjects become republican states and that in these circumstances law can exist without a global state. Dafür zeigen wir anhand von Schüler_innen mit eingeschränkten Kommunikationsmöglichkeiten auf, wie Philosophieren mit ihnen dennoch möglich ist. Gleichzeitig wenden wir uns im Beitrag dem Haupteinwand zu, der darin besteht, dass Philosophieren mit dieser Schüler_innengruppe nicht möglich sei. Wir erklären unter welchen Umständen dieser Einwand nicht aufrecht erhalten werden sollte, sondern vielmehr (...) eine moralische Pflicht besteht, Menschen mit Behinderung philosophische Bildungsprozesse zu ermöglichen. She who has not been aware of the final combat, nor of the slaying of her husband, is suddenly confronted by the receding trail of utter defeat. Swift horses drag her husband's corpse into the distance, the cherished head disfigured as it is dragged, raking the dust of what was once their homeland. (...) The violence of the scene is forcefully conveyed by one word in particular. The swift horses drag Hektor κηδστως —without κδος without care, ‘sans soucier de, brutalement’. In itself the word κηδστως provides a definition of violence, one captured in Shakespeare's phrase ‘careless force’. Violence is, in its harsh brutality, specifically heedlessness, an absence of any form of care. When Achilles hurls the slain suppliant Lykaon into the river he utters the taunt, ‘the fish, κηδες, will lick clean your wound's blood’ . The discarded corpse is denied funeral rites: in place of the care that the relations of the dead traditionally bestow in tending, washing, enshrouding, lamenting, and burying the dead, here the heedless creatures of nature, fleeting visitors, will attend to the corpse, ‘clean’ it, but utterly without care, completely oblivious to the oblivion they create by destroying. The focus of this article is on a curious episode at the end of the first book of Tacitus’Annals. It is argued that Tacitus here is at his most metaphoric and allusive, allowing a senatorial debate on the possibly prophetic meaning of an inundation of the Tiber to become a debate about the overwhelming power of the river's namesake Tiberius. Parallels from Dio (and perhaps also from Livy) indicate that inundations of the Tiber by the end of the Republic had (...) become prophetic warnings of the rise of the dynasts undermining the stability of the Republic. In Tacitus, procedural anomalies and suggestive wordplay bring to the fore the religious and constitutional issues that in the Senate's handling of this Tiberineprodigiumreflect its submission to the ever more oppressive power of Tiberius. During the precolonial period Zulu identity was based on a set of cultural markers defined by the royal family. But European linguists extended the borders of Zulu, as a written language, to include the peoples living to the south of the Tugela river in the colony of Natal. Folklorists, anthropologists, historians, and other social scientists, as well as European employers, adopted this view of the Zulu as a people or Volk. Following the defeat of the Zulu kingdom in 1879, and (...) the decline of the royal family, migrant workers increasingly returned home with this new notion of what it meant to be Zulu. This essentially European interpretation of the word was embraced and spread by Christian converts who, in the twentieth century, sought to mobilize an ethnic political following.Chief Mangosuthu Buthelezi has continued with this tradition. In his speeches he represents the Zulu in primordial terms as a bounded group that historically has occupied both Natal and the old precolonial kingdom. The bantustan of KwaZulu, delineated and defined by the policy of apartheid, is presented as the natural heir to the Zulu kingdom and the Inkatha Freedom Party is portrayed as the guardian of the essence of Zuluness. An attractive historical self-imagery encourages people to define themselves in an exclusive manner as Zulu. Firm values and standards provide an ontological security and a network of assistance for sons abroad. Through a martial imagery, Buthelezi has represented the seven million Zulu as historically the most powerful obstacle to white supremacy. But since the resurgence of nationalist politics in the mid-1980s, and especially since the democratization started in 1990, Inkatha has attempted to attract the Zulu as a people in opposition to the ANC and their allies. This has most visibly resulted in a violent struggle for power; but it has also led to a virulent struggle over what it means to be Zulu. (shrink)

We present a matrix model for the study of the population dynamics of brown trout Salmo trutta L., introduced in the '60s in the virgin aquatic ecosystems of the Kerguelen Islands. This species clearly acclimatized very well: a portion of the population became migratory and spent a part of its life cycle in the sea, which allowed the rapid colonization of two rivers close to the stream of origin in the same bay (Baie Norvégienne).These migratory trout can become a (...) smolt at 2, 3, or 4 years of age. The model takes into account age and smolt age structures and in a first step considers the fish from the Baie Norvégienne as belonging to a single population. The transition matrix looks like a 32 × 32 Leslie matrix in which some survival rates are not on the subdiagonal. They represent survival after the first sea migration and are particularly important for the dynamics of the whole population. (shrink)

Ruth Myrtle Patrick was a pioneering ecologist and taxonomist whose extraordinary career at the Academy of Natural Sciences of Philadelphia spanned over six decades. In 1947, an opportunity arose for Patrick to lead a new kind of river survey for the Pennsylvania Sanitary Water Board to study the effects of pollution on aquatic organisms. Patrick leveraged her already extensive scientific network, which included ecologist G. Evelyn Hutchinson, to overcome resistance within the Academy, establish a new Department of (...) Limnology, and carry out the survey, which was a resounding success and brought much needed money to the Academy. As demand for her expertise grew among industrial companies, such as the chemical company DuPont, Patrick became more active in the world of applied science. She repurposed data and instruments from her river surveys to run new experiments, test ecological theories, and conduct long-term ecological studies. Through these studies, she advanced an argument that biologist Thomas Lovejoy dubbed the “Patrick principle,” the idea that the ecological health of a body of water could be measured by the relative abundance and diversity of species living there. Patrick was elected to the National Academy of Sciences in 1970, became a board member of DuPont in 1975, and received two of the most prestigious awards in ecology: the Eminent Ecologist Award from the Ecological Society of America in 1972 and the Tyler Ecology Award in 1975. This article analyzes Patrick’s unusual success in bridging the worlds of science and industry and her unusual ability to cross, and redefine, the perceived boundary between basic and applied fields in biology. It argues that Patrick’s position at the Academy, an institution of natural history that was both willing and able to accept money from industrial corporations, is key to understanding her success in, and influence on, the field of river ecology. This study investigates antecedents of corporate social responsibility in multinational corporations' subsidiaries. Using stakeholder theory and institutional theory that identify internal and external pressures for legitimacy in MNCs' subsidiaries, we integrate international business and CSR literatures to create a model depicting CSR practices in MNCs' subsidiaries. We propose that MNCs' subsidiaries will be likely to adapt to local practices to legitimize themselves if they operate in host countries with different institutional environments and demanding stakeholders. We also predict that MNCs' subsidiaries (...) will be likely to adapt to local practices to avoid spillover effects if their parent companies suffer major legitimacy problems at home or abroad. However, we speculate that MNCs' subsidiaries will be less likely to adapt to local practices if they are strongly annexed to their parent companies and the benefit to gain internal legitimacy outweighs external legitimacy. This article contributes to the discourse on CSR across borders by exploring the antecedents of CSR practices in MNCs' subsidiaries at social and organizational levels, and integrating institutional and stakeholder views. We provide a number of propositions for future studies and explore implications for practitioners. (shrink)

Although wonder is a response to what is extraordinary or regarded as such, this covers a variety of things. Hence, wonder covers a spectrum from mere surprise or puzzlement to stronger responses like dread or amazement; moreover, it is often linked to other powerful responses like fear or admiration, and it can lead people into many pursuits and areas of reflection. I look at the variety of the objects of wonder, and of the neighbouring responses and conceptual connections found here, (...) then I discuss the response of wonder itself, and its causes and effects. Finally, I ask why the sense of wonder can atrophy, and whether it can be suppressed deliberately. (shrink)

I outline a pragmatic account of evidence, arguing that it allows us to underwrite two implications of feminist scholarship: that knowledge is socially constructed and constrained by evidence, and that social relations, including gender, race, and class, are epistemologically significant. What makes the account promising is that it abandons any pretense of a view from nowhere, the view of evidence as something only individuals gather or have, and the view that individual theories face experience in isolation.

The persistence, and international expansion, of food banks as a non-governmental response to households experiencing food insecurity has been decried as an indicator of unacceptable levels of poverty in the countries in which they operate. In 1998, Poppendieck published a book, Sweet charity: emergency food and the end of entitlement, which has endured as an influential critique of food banks. Sweet charity‘s food bank critique is succinctly synthesized as encompassing seven deadly “ins” (1) inaccessibility, (2) inadequacy, (3) inappropriateness, (4) indignity, (...) (5) inefficiency, (6) insufficiency, and (7) instability. The purpose of this paper is to examine if and how the contemporary food bank critique differs from Sweet charity’s “ins” as a strategy for the formulation of synthesizing arguments for policy advocacy. We used critical interpretive synthesis methodology to identify relationships within and/or between existing critiques in the peer-reviewed literature as a means to create “‘synthetic constructs’ (new constructs generated through synthesis)” of circulating critiques. We analyzed 33 articles on food banks published since Sweet charity, with the “ins” as a starting point for coding. We found that the list of original “ins” related primarily to food bank operations has been consolidated over time. We found additional “ins” that extend the food bank critique beyond operations (ineffectiveness, inequality, institutionalization, invalidation of entitlements, invisibility). No synthetic construct emerged linking the critique of operational challenges facing food banks with one that suggests that food banks may be perpetuating inequity, posing a challenge for mutually supportive policy advocacy. The relationship between ethics and economics has never been easy. Opponents in a tug of war, friends in a warm embrace, ships passing in the night—the relationship has been highly variable. In recent years, the friendship model has been gaining credence, particularly among U.S. corporate executives. Increasingly, companies are launching ethics programs, values initiatives, and community involvement activities premised on management’s belief that “Ethics pays.”.

The starting point of this paper is a version of intra-theoretical pluralism that was recently proposed by Hjortland [2013]. In a first move, I use synonymy-relations to formulate an intuitively compelling objection against Hjortland's claim that, if one uses a single calculus to characterise the consequence relations of the paraconsistent logic LP and the paracomplete logic K3, one immediately obtains multiple consequence relations for a single language and hence a reply to the Quinean charge of meaning variance. In a second (...) move, I explain how a natural generalisation of the notion of synonymy can be used to counter this objection, but I also show how the solution can be turned into an equally devastating ‘one logic after all’ type of objection. Finally, I propose the general diagnosis that these problems could only arise in the presence of conceptual distinctions that are too coarse to accommodate coherent pluralist theses. T.. (shrink)

Scotland is usually portrayed as being a country that had weak and terrible queens, like Margaret Tudor and Mary Queen of Scots. Saint Margaret is the only queen who is constantly portrayed positively. However, that is not because of her actions as queen consort, but because she was a devote Christian. Scotland is also portrayed for not producing well known or strong female rulers. This essay will examine two contemporary female rulers from the mid-fifteenth century, one from Scotland, Eleanor of (...) Scotland, and one imported to Scotland, Mary of Gueldres. Using these case studies it will be demonstrated that Scotland did produce strong female rulers along with acquiring them. (shrink)

ABSTRACT Nietzsche's investigation into the origins of morality bears some striking similarities to contemporary investigations into human evolution. Here I investigate these similarities, using a comparison between Nietzsche's GM and Gould and Lewontin's influential “Spandrels” essay as a departure point. I argue that Nietzsche defends a proto-evolutionary psychology about morality, where the inheritance of enduring biological drives conflicts with our culturally evolved moral system. While Nietzsche's claims about the evolution of morality fit well within a Darwinian framework of natural selection, (...) his claims about our underlying biology do not. Those claims cohere better with the non-Darwinian views found in nineteenth-century German biology and embryology. (shrink)

The author argues for the importance of non-Markovian causality in the social sciences because Markovian conditions often cannot be satisfied. Two theorems giving conditions for non-Markovian causes to be transitive are proved. Applications of non-Markovian causality in psychology and economics are outlined.

In this paper I present a more refined analysis of the principles of deductive closure and positive introspection. This analysis uses the expressive resources of logics for different types of group knowledge, and discriminates between aspects of closure and computation that are often conflated. The resulting model also yields a more fine-grained distinction between implicit and explicit knowledge, and places Hintikka’s original argument for positive introspection in a new perspective.

This paper examines, on the basis of a longitudinal corpus of 50 early modern authors, how change at the aggregate level of the community interacts with variation and change at the micro-level of the individual language user. In doing so, this study aims to address the methodological gap between collective change and entrenchment, that is, the gap between language as a social phenomenon and the cognitive processes responsible for the continuous reorganization of linguistic knowledge in individual speakers. Taking up the (...) case of the prepositional passive, this study documents a strong community-wide increase in use that is accompanied by increasing schematicity. A comparison of the 50 authors reveals that regularities arising at the macro-level conceal highly complex and variable individual behavior, aspects of which may be explained by studying the larger (social) context in which these individuals operate (e. g., age cohorts, community of practice, biographical insights). Further analysis, focusing on how authors use the prepositional passive in unique and similar ways, elucidates the role of small individual biases in long-term change. Overall, it is demonstrated that language change is an emergent phenomenon that results from the complex interaction between individual speakers, who themselves may change their linguistic behavior to varying degrees. In this article, we critique two theoretical positions that analyze the place of emotions in education: the psychological strand and the cultural feminist strand. First of all, it is shown how a social control of emotions in education is reflected in the combination of psychological and cultural feminist discourses that function to govern one’s self effectively and efficiently. These discourses perpetuate an assumed divide between the rational and the emotional, and reinforce the existing power hierarchies and the status quo of (...) stereotypes about the role of emotion in education. Then we use the Foucauldian notions of parrhesia and care of the self to suggest alternative ways of thinking about emotions in education. Instead of campaigning for one side or the other of the rational/emotional divide, we suggest that it may be more interesting and fruitful to examine the particular ways discourses of emotion in education construct their own brand of parrhesia. Modal logics have in the past been used as a unifying framework for the minimality semantics used in defeasible inference, conditional logic, and belief revision. The main aim of the present paper is to add adaptive logics, a general framework for a wide range of defeasible reasoning forms developed by Diderik Batens and his co-workers, to the growing list of formalisms that can be studied with the tools and methods of contemporary modal logic. By characterising the class of abnormality models, (...) this aim is achieved at the level of the model-theory. By proposing formulae that express the consequence relation of adaptive logic in the object-language, the same aim is also partially achieved at the syntactical level. (shrink)

The Daily Spiritual Experience Scale is an instrument designed to provide researchers with a self-report measure of spiritual experiences as an important aspect of how religiousness/spirituality is expressed in daily life for many people. The sixteen-item scale includes constructs such as awe, gratitude, mercy, sense of connection with the transcendent, compassionate love, and desire for closeness to God. It also includes measures of awareness of discernment/inspiration and transcendent sense of self. This measure was originally developed for use in health studies, (...) but has been increasingly used more widely in the social sciences, for program evaluation, and for examining changes in religious/spiritual experiences over time. It has been included on the U. S. General Social Survey , and the items have shown high prevalence in that population. The challenge of identifying items that tap the underlying constructs was addressed through qualitative methods, both in the development and testing of the instrument. Translations have been made into Spanish, Korean, Hebrew, Vietnamese, and French, and the scale has been effectively used outside the United States. Detailed discussion of item construction based on qualitative work is given to assist in use, interpretation and translation development. Options for scoring and suggestions for exploring correlations with other variables using individual items and subgroups are also presented. (shrink)
